Hello,I recently had a foundation company do some work on my house. I had them come out and look at things first, they drew up a statement of work and emailed it to me. In this email chain I was speaking about working out a payment plan, half upfront and the rest over 4 months. After the amount and terms were agreed upon, they provided me with wire information and I wired the first half ($2250).They came and did the work, and invoiced me afterwords with the full amound of $4500 listed due. I asked that they update the invoice with the downpayment already sent, and they responded with "What downpayment?"I was floored. We had emailed back and forth for several days. The person I spoke with said that they knew we had emailed about the costs and such, as well as having sent me plans, but their email had been hacked and they had no records of conversations after a certain point in the email chain, which was about the point that they mentioned sending wire transfer info to send the downpayment. I screen shot everything, and now noticed that the business name provided for the wire transfer was one letter off from their own business name.Now they are trying to get me to cover the lost funds as well as the remaining amount. I told them that I agreed to pay the remaining half, and that I have a fraud claim open with my bank.Is there any legal recourse I can take to protect myself from having to re-pay the half that was stolen due to a security breach on their end? Do business insurance companies tend to cover for theft through security breaches?
